At You Are Magnifique, we place great importance on your trust and the protection of your personal data. This policy clearly explains how we collect, use, retain and protect your data when you visit our website, create an account, place an order, take out a subscription, contact us, participate in a survey or competition, or choose to receive our communications.

2. Scope and applicable law
This policy applies to the processing of personal data carried out in connection with the activities of You Are Magnifique. Such processing is primarily subject to the Swiss Federal Act on Data Protection (FADP). The European Union General Data Protection Regulation (GDPR) also applies when processing falls within its territorial scope.
3. Data we may collect
Depending on how you interact with YAM, we may collect the following categories of data:
identification and contact details: surname, first name, postal address, email address, telephone number and, if you choose this channel, WhatsApp contact details;
account, orders and subscriptions: account identifiers, order history, products ordered, subscription status, deliveries, returns, refunds and exchanges with customer service;
payment: information required to process and monitor payment. Full bank card details are normally processed directly by payment service providers and are not retained by YAM;
marketing and preferences: subscriptions, unsubscriptions, selected channels, proof and date of consent, preferences and interactions with our communications;
surveys, competitions and forms: responses, reviews, participation, contact details needed for prize draws and, where applicable, delivery of the prize;
technical data: IP address, device and browser type, language, connection logs, cookie identifiers, pages viewed and information required for the operation, audience measurement and security of the website;
communications: content of messages sent by email, form, telephone, social networks or other channels.
We ask you not to communicate medical data or other sensitive data in free-text response fields unless this is expressly necessary and requested with the appropriate information and safeguards.
4. Sources of data
We mainly collect data directly from you. Certain information may also be transmitted to us by the platforms you use to interact with YAM, including Shopify, Meta (Facebook and Instagram), and payment, delivery or communication service providers, in accordance with their own terms and privacy settings.
5. Purposes and legal bases of processing
We process your data only for a specified purpose and where such processing is based on an admissible legal basis. Depending on the circumstances, we use it to:
manage your account, orders, payments, deliveries, subscriptions, returns and refunds in order to perform the contract entered into with you;
respond to your requests and provide customer service, as part of pre-contractual measures, performance of the contract or our legitimate interest in assisting you;
comply with our accounting, tax, regulatory and legal obligations;
prevent fraud, secure the website, protect our rights and establish, exercise or defend legal claims, on the basis of our obligations and legitimate interests;
measure, understand and improve our website, products, services and communications, on the basis of our legitimate interest or your consent where required;
analyse surveys and better understand our customers’ expectations, on the basis of your voluntary participation and our legitimate interest in developing our offers;
organise competitions and prize draws, record entries, select and contact winners and deliver prizes, in accordance with the competition rules;
send you newsletters, offers or commercial communications only where you have consented or where the law expressly permits such sending.
6. Email and WhatsApp communications
Signing up for our commercial communications is optional and separate from any order or participation in a survey or competition. Where several channels are offered, you must be able to express your choice separately for email and WhatsApp. You may withdraw your consent at any time, without retroactive effect, by using the unsubscribe link in our emails, replying “STOP” on WhatsApp or writing to hello@youaremagnifique.com .
After you unsubscribe, we may retain minimal information on a suppression list in order to respect your choice on an ongoing basis.
7. Surveys, competitions and forms
Participation in a survey or competition does not automatically result in a newsletter subscription. Where an email address is required to manage an entry or contact a winner, it is used for that purpose. Any marketing use is based on a separate choice.
Competitions and prize draws are subject to specific terms that set out, in particular, the participation rules, duration, prize, method used to select the winner and any territorial restrictions.
8. Meta, Facebook and Instagram
When you interact with YAM on Facebook or Instagram, or complete a Meta instant form, Meta processes certain data under its own responsibility and may then transmit to YAM the information you have chosen to provide. Use of these platforms is also subject to Meta’s privacy policy. Competitions organised by YAM are not managed, sponsored or administered by Meta unless expressly stated otherwise.
9. Recipients and processors
Your data is not sold. It is accessible only to authorised persons within YAM and, to the extent necessary, to the following categories of recipients:
hosting, e-commerce platform and maintenance providers, including Shopify and the hosting services used by YAM;
payment service providers, financial institutions and fraud-prevention services;
order preparation, logistics, delivery and returns management providers;
emailing, messaging, forms, customer relationship management and support providers, including Infomaniak when its services are used;
analytics, advertising and social media providers, including Meta when its services are used;
professional advisers, insurers, authorities or courts where required by law, the protection of our rights or legal proceedings.
We require our providers to process data only in accordance with our instructions, their contractual obligations and applicable law, except where they act as data controllers in their own right.
10. International transfers
Our activities are managed from Switzerland. Certain international digital service providers, including those connected with the e-commerce platform, payments, social networks, analytics or communications, may process data in Switzerland, the European Economic Area, the United Kingdom, Canada, the United States or other countries in which they have authorised providers.
Where data is transferred to a country that is not recognised as providing an adequate level of protection, we rely on safeguards permitted by applicable law, including recognised standard contractual clauses, supplemented where necessary by additional protection measures, or on an applicable legal derogation. 11. Cookies and similar technologies
Our website uses cookies and similar technologies. Some are essential for the operation of the shop, shopping cart, payment and security, or for remembering your choices. Others may be used to measure audience, personalise the experience or evaluate our advertising campaigns.
Where the law requires your consent, non-essential cookies are activated only after you have made your choice. You can accept, refuse or change your preferences using the cookie management tool available on the website. Refusing non-essential cookies does not prevent access to essential functions. Details of the cookies used, their providers, purposes and retention periods must be available in the website’s settings or cookie policy.
12. Retention periods
We retain data only for as long as necessary for its purpose, subject to legal obligations and the need to defend our rights. In principle:
order, payment and billing data and accounting records are retained for the applicable statutory period, generally ten years in Switzerland;
customer account data is retained for the lifetime of the account, then deleted or anonymised when no longer necessary, subject to data that must be retained by law;
requests addressed to customer service are retained for the time necessary to process them and follow up the relationship, then deleted or anonymised;
survey responses are retained for the time required for their analysis, then deleted or anonymised;
data relating to a competition is retained until delivery of the prize and for the period necessary to document the proper conduct of the competition or handle a dispute;
data used for commercial communications is retained until consent is withdrawn, an objection is made or it is no longer useful, subject to retaining proof of consent or a minimal record on a suppression list;
technical logs and security data are retained for a period proportionate to the risk and security requirements.
13. Your rights
Within the limits and under the conditions provided by applicable law, you may request:
access to personal data concerning you;
rectification of inaccurate or incomplete data;
deletion of your data;
restriction of processing;
provision or portability of certain data in a commonly used format;
objection to certain processing, in particular direct marketing;
withdrawal of your consent at any time, without affecting the lawfulness of processing already carried out.

You may also contact the Swiss Federal Data Protection and Information Commissioner (FDPIC). Where the GDPR applies, you may lodge a complaint with the competent data protection authority in your country of residence, your place of work or the place of the alleged infringement.
14. Automated decision-making
YAM does not make decisions based solely on automated processing that produce legal effects or significantly affect you, unless this is necessary for a contract, authorised by law or based on your explicit consent, with the safeguards provided by applicable law.
15. Security
We implement technical and organisational measures appropriate to the risk in order to protect data against loss, destruction, unauthorised access, alteration or disclosure. However, no system provides absolute security. In the event of a data breach, we take the required measures and notify the authorities or persons concerned where required by law.
16. Minors
YAM’s offers are intended for adults. We do not knowingly seek to collect data from minors. If you believe that a minor has provided us with data without appropriate authorisation, please contact us so that we can take the necessary measures.
17. Links to third-party services
Our website and communications may contain links to external services. Their use is subject to the privacy policies of their operators. YAM is not responsible for processing carried out independently by those third parties.
18. Changes to this policy
We may update this policy to reflect changes in our activities, service providers or legal requirements. The version published on this page is the version currently in force. In the event of a significant change, we will take reasonable steps to inform you where required.
